1. Acceptance of Terms

These Terms of Service govern your access to and use of the Msomi Parent App provided by Msomi. By downloading, installing, registering for, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the App.

You represent that you are at least 18 years old and legally capable of entering into a binding agreement, or that you are using the App as a parent or legal guardian with authority over the student accounts you manage.

2. Description of Services

The App enables parents and guardians to:

  • View and manage student digital wallet balances linked to participating schools.
  • Top up student wallets using supported payment methods (including M-Pesa where available).
  • Monitor NFC tap-to-pay spending at approved merchants.
  • Set daily and weekly spending limits and low-balance alerts.
  • Manage student Msomi cards (including freeze, unfreeze, and replacement requests).
  • View wallet and transaction history, including recent activity and detailed records.
  • Access profile, support, and account settings.

Features may vary by school, merchant participation, and region. We may add, modify, or discontinue features at any time with reasonable notice where practicable.

3. Account Registration and Security

You must provide accurate, current, and complete information when creating an account and keep your details up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

Notify us immediately at support@mymsomi.co.ke if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a security risk.

4. Student Accounts and Parental Responsibility

Student wallets and cards linked to your account are managed under your authority. You are responsible for supervising how students use linked cards and for settings you configure (including spending limits). Schools may impose additional rules that apply to student wallet programmes.

We are not responsible for disputes between you and a school regarding enrolment, fees outside the wallet programme, or disciplinary matters unrelated to App functionality.

5. Payments and Top-Ups

Wallet top-ups are processed through third-party payment networks (such as M-Pesa). By initiating a top-up, you authorise us and our payment partners to debit your selected payment source for the specified amount plus any applicable network or service fees charged by the payment provider.

All amounts displayed in the App are in Kenyan Shillings (KES) unless otherwise stated. You are responsible for ensuring sufficient funds are available in your payment source before confirming a top-up.

6. NFC Tap-to-Pay and Merchant Transactions

Student tap-to-pay purchases are processed at participating merchant terminals. Transaction approvals depend on available wallet balance, active card status, spending limits you set, and merchant terminal availability. We do not guarantee that every merchant or terminal will accept every transaction.

Disputes about goods or services purchased at a merchant should first be raised with the merchant. We may assist with transaction investigation where our systems record relevant data.

7. Prohibited Conduct

You agree not to:

  • Use the App for unlawful, fraudulent, or abusive purposes.
  • Provide false information or impersonate another person.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Reverse engineer, decompile, or interfere with the App except as permitted by law.
  • Use automated means to scrape or overload our services without permission.
  • Circumvent spending limits, security controls, or card restrictions.

8. Fees

We may publish fees for certain services in the App or on our website. Mobile-money providers and other third parties may charge separate transaction fees. You are responsible for all such third-party charges unless we expressly state otherwise.

9. Intellectual Property

The App, including its software, design, logos, and content, is owned by Msomi or its licensors and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

10. Disclaimers

THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MSOMI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) KES 5,000, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

12. Indemnification

You agree to indemnify and hold harmless Msomi from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the App, violation of these Terms, or infringement of third-party rights, except to the extent caused by our gross negligence or wilful misconduct.

13. Suspension and Termination

You may stop using the App at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service. Provisions that by nature should survive (including liability limits and dispute terms) will survive termination.

14. Changes to These Terms

We may revise these Terms from time to time. Updated Terms will be posted at the URL hosting this document and/or communicated through the App. Material changes take effect on the date stated in the updated Terms. Continued use after that date constitutes acceptance.

15. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles. Disputes shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to the competent courts of Kenya.
