1. Introduction

This Privacy Policy explains how Msomi collects, uses, stores, and protects personal and business information when you use the Msomi Merchant App and related services. We are committed to protecting the personal data of merchant representatives and their staff who interact with our platform.

2. Information We Collect from Merchants

• Business information: business name, registration number, physical address, school affiliation, and merchant category.
• Contact details: name and contact information of merchant representatives or owners.
• Financial information: bank account or mobile-money details for settlement purposes, transaction amounts, receipts, and settlement records.
• Terminal data: terminal identifiers, device serial numbers, and transaction logs generated by NFC payment terminals.
• Usage and support data: how you interact with the merchant portal, support communications, and dispute records.

3. How We Use Merchant Information

• Onboard and verify your merchant account and terminal(s).
• Process and settle NFC tap-to-pay transactions.
• Generate reports and analytics for your business performance on the Msomi network.
• Investigate disputes, suspected fraud, or policy breaches.
• Comply with applicable laws and regulatory requirements.
• Communicate service updates, fee changes, and programme notices.

4. Sharing of Merchant Information

• Partner schools may receive aggregated or anonymised transaction data relevant to their programme.
• Payment processors and settlement banks to execute fund transfers to your account.
• Regulatory authorities where required by law, including financial regulators and tax authorities.
• Cloud infrastructure providers operating under confidentiality obligations.

We do not sell merchant information to third parties for marketing purposes.

5. Data Security

We protect merchant data with encryption in transit and at rest, role-based access controls, and regular security reviews. Terminal transaction data is treated as sensitive financial data and stored under equivalent protections to consumer financial data.

6. Retention

We retain merchant account and transaction data for a minimum of seven years to comply with financial record-keeping regulations in Kenya, or longer if required by law or ongoing dispute resolution.

7. Your Rights

Merchant representatives may request access to, correction of, or deletion of their personal information by contacting support@mymsomi.co.ke. Business transaction records may be exempt from deletion requests where retention is required by law.

8. Changes

We may update this policy. Material changes will be communicated through the merchant portal or by email to your registered address. Continued use of merchant services constitutes acceptance.
